RULES AND REGULATIONS POLICY At The Cross Health and Performance, our mission is to create a welcoming, safe, and effective fitness environment. To ensure a positive experience for all members, we ask that you abide by the following rules and regulations:

1. FACILITY USE:
Members should respect all equipment and facilities, returning equipment to its original location after use.
Misuse of equipment or facilities, including behaviour that may cause damage, is not permitted.

2. CONDUCT:
Members are expected to display respectful and considerate behaviour towards others. Aggressive, intimidating, or harassing behaviour will not be tolerated.
The Company is a judgment-free zone. Members should respect the abilities and efforts of others, regardless of their fitness level or progress.

3. SAFETY:
Members must adhere to safety instructions given by trainers.
Members should inform trainers of any physical conditions or concerns that may affect their ability to exercise safely.
Appropriate fitness attire, including athletic shoes, should be worn at all times in the gym area.

4. HYGIENE:
Members are expected to maintain good hygiene. This includes wiping down equipment after use.
Personal items should be stored in lockers or designated storage areas. The gym floor should be kept free of clutter to prevent accidents.

5. SESSION ATTENDANCE:
Members are encouraged to arrive on time for sessions to ensure a proper warm-up and to minimise disruption.
If a member cannot attend a booked session, they should cancel as soon as possible to free up space for others.

6. PAYMENTS:
Payments should be made promptly as per the terms of your membership. If you encounter issues with payment, please discuss this with our staff.

7. PRIVACY:
Respect the privacy of others. Do not take photos or videos of others without their explicit consent.

Failure to comply with these rules may result in a warning, suspension, or termination of membership. By using our facilities and services, members agree to abide by these rules and regulations.

MEMBER HEALTH AND SAFETY POLICY The Cross Health and Performance prioritises the health and safety of our members and staff. The following policies are designed to promote a safe, welcoming environment for everyone.

1. GENERAL SAFETY:
Members should always follow the instructions given by our trainers to ensure safety. If a member is uncertain about how to use any equipment, they should ask for assistance.
Members are asked to wipe down equipment after use with the cleaning supplies provided.
Members should notify staff immediately in case of equipment malfunction or any potential safety hazards.

2. MEDICAL CONCERNS:
Members should inform The Cross Health and Performance of any known medical conditions or other conditions that might affect their ability to exercise.
Members who feel dizzy, faint, or unwell should immediately stop exercising and inform a staff member.
In case of an emergency, staff will follow the necessary protocol to ensure the member's safety and, if necessary, seek medical help.

3. PERSONAL BELONGINGS:
The Cross Health and Performance is not responsible for any loss, theft, or damage to personal belongings.

4. APPROPRIATE ATTIRE:
Members must wear suitable sportswear and indoor athletic shoes while in the gym.

5. RESPECT FOR OTHERS:
Members should respect the rights, dignity, and worth of all participants regardless of their gender, ability, cultural background, or religion.
Aggressive, intimidating, harassing, or disrespectful behaviour will not be tolerated.

MEMBERSHIP POLICY
Our goal at The Cross Health and Performance is to provide our members with the best possible environment for achieving their fitness goals. To ensure a smooth, safe, and effective experience for all members, we have established the following membership policy:

1. TYPES OF MEMBERSHIPS:
We offer several types of memberships, including Hybrid Memberships, Unlimited Membership, 3x Weekly Membership, 2x Weekly Membership, 10 Session Passes and Open Gym Membership to cater to the different needs of our members. Members are responsible for selecting the membership type that best fits their needs.

2. PAYMENT:
Membership fees are due at the start of each billing cycle. Payments must be made promptly as per the terms of your membership agreement.

3. USE OF FACILITY:
Members are entitled to use The Cross Health and Performance's facilities within the scope of their membership type and must adhere to The Cross Health and Performance's rules and regulations stated lower.

4. BOOKING AND ATTENDANCE:
Members are required to book sessions in advance and encouraged to arrive on time to maximise the benefit of their workout and to minimise disruption to others.

5. CANCELLATION AND HOLD:
Members wishing to cancel or place their membership on hold must do so in accordance with our Cancellation Policy and Hold Policy.

6. CHANGE IN MEMBERSHIP DETAILS:
Members are responsible for notifying The Cross Health and Performance of any changes in their personal information, including address, contact details, and payment information.

7. HEALTH AND SAFETY:
Members are responsible for monitoring their condition during exercise and should inform a trainer immediately if they feel unwell or experience any physical discomfort.

8. PRIVACY:
The Company is committed to maintaining the privacy of its members. All personal information collected is handled in accordance with our Privacy Policy.

By becoming a member of the The Cross Health and Performance, you agree to abide by this Membership Policy. Failure to comply may result in a warning, suspension, or termination of membership. FEE AND PAYMENT AGREEMENT This Fee and Payment Agreement is between you, the Member, and The Cross Health and Performance, located at 13 Lentini Street Hoppers Crossing.

1. MEMBERSHIP FEES:

The membership fees depend on the type of membership plan chosen by the Member:

Hybrid Memberships: $149 or $199 p/w

Unlimited Membership: $65p/w

3 x Weekly Membership: $55p/w

2 x Weekly Membership: $45p/w

10 Sessions Pass: $250 (90 Day expiry)

Open Gym Membership: $20p/w

Drop In Membership: $30 p/s

2. PAYMENT TERMS:
The Member agrees to pay The Cross Health and Performance the agreed membership fee via an automatic weekly/fortnightly/monthly debit from the Member's nominated bank account or credit card on the same date of each week/fortnight or month.
If a payment is not successful due to insufficient funds, the Company will contact the Member. The Company may, at its discretion, apply a late fee.

3. LATE PAYMENT:
In the event of a late payment, the members access to The Cross Health and Performance's facility may be suspended until the outstanding balance is paid.

4. CHANGES IN MEMBERSHIP FEES:
The Cross Health and Performance reserves the right to adjust membership fees. Members will receive at least 30 days' notice of any changes.

5. CANCELLATION:
Please see The Cross Health and Performance cancellation policy for more information.

6. REFUNDS:
Membership fees are non-refundable except as otherwise stated in the Company's Cancellation Policy.
MEMBERSHIP HOLD POLICY At The Cross Health and Performance, we understand that life can sometimes interrupt your fitness journey. That's why we've designed a membership hold policy that provides you with the flexibility to pause your membership when you need to.

Please carefully read the following terms to understand our hold policy:

1. HOLD REQUEST:
Membership holds must be requested in writing to Luke (luke@thecrosshealthandperformance.com) or Samantha (samantha@thecrosshealthandperformance.com) at least seven (7) days before the hold period begins.

2. HOLD DURATION:
Memberships can be placed on hold for a minimum of two (2) weeks up to a maximum of eight (8) weeks in a calendar year.
For medical reasons or injuries, we offer a longer hold period. Such requests should be supported by a medical certificate or letter from your doctor.

3. PAYMENT DURING HOLD:
During the hold period, no membership fees will be charged. Billing will automatically resume once the hold period ends.

4. HOLD EXTENSION:
If you need to extend the hold period, please notify us via email at least seven (7) days before the hold period ends.

5. RETURNING EARLY:
If you wish to return to the gym before the end of your hold period, please notify us via email, and we will resume your billing and access immediately.

6. EXCEPTIONS:
Members on promotional memberships, short-term memberships (less than three months), or paid-in-full memberships are not eligible for holds.

By understanding and abiding by this policy, we can ensure a fair system that caters to the needs of all our valued members.

MEMBERSHIP CANCELLATION POLICY At The Cross Health and Performance we value our members and their commitment to health and fitness. We understand that circumstances may change, and you may need to cancel your membership. To ensure a smooth and fair process, we have outlined the following cancellation policy:

1. REQUESTING CANCELLATION:
Cancellation requests must be submitted in writing to Luke (luke@thecrosshealthandperformance.com) or Samantha (samantha@thecrosshealthandperformance.com).
We do not accept cancellation requests made in person, over the phone, or through social media.

2. NOTICE PERIOD:
As we don't have contracts for our memberships, we don't need a notice but would be encouraged to give at least 7 days so our admin team can process the cancellation effectively and efficiently.

3. FINAL PAYMENT:
If a payment falls within the 7 day period, that payment will be processed as usual, and your access to our services will continue until the end of that paid period.

4. REFUNDS:
We do not offer refunds for unused membership periods, services, or fees.

5. RETURNING MEMBERS:
If you wish to re-join after cancellation, membership will be subject to current rates and will not be available at the rate of your previous membership.

6. EXCEPTIONS:
Under certain circumstances, we may waive the notice period. These circumstances may include serious injury or illness confirmed by a doctor's certificate. Each case will be considered individually.

PRIVACY POLICY At The Cross Health and Performance your privacy is of utmost importance to us. This Privacy Policy outlines the types of personal information we collect, how we use it, and the steps we take to ensure your personal information is handled appropriately.

1. COLLECTION OF INFORMATION:
We collect information from you when you become a member of the Company. This may include: Personal identification information (name, email address, phone number, etc.)
Health-related information needed to assess your readiness for physical exercise Payment information for processing membership fees

2. USE OF INFORMATION:
We use the information we collect from you for the following purposes: To personalise your experience and cater to your individual needs To improve our facility and services To process transactions To send periodic emails, newsletters, and updates

3. PROTECTION OF INFORMATION:
We implement a variety of security measures to maintain the safety of your personal information. These measures include physical security, technical security measures (including password protection and encryption), and administrative protocols.

4. DISCLOSURE TO THIRD PARTIES:
We do not sell, trade, or otherwise transfer your personally identifiable information to outside parties. This does not include trusted third parties who assist us in operating our business or servicing you, so long as those parties agree to keep this information confidential.

5. ACCESS AND CONTROL OF INFORMATION:
You have the right to access, correct, or delete your personal information held by the Company. Requests should be made in writing to our customer service team.

6. CHANGES TO PRIVACY POLICY:
We reserve the right to amend this policy at any time. All amendments to this Privacy Policy will be posted on our website. Unless otherwise stated, the current version shall supersede and replace all previous versions of this Privacy Policy.

New Member Liability Waiver

This agreement is entered into by and between The Cross Health and Performance PTY LTD, located at 13 Lentini Street, Hoppers Crossing, Vic, 3029, hereinafter referred to as "Company," and the undersigned, hereinafter referred to as "Participant."

  1. ACKNOWLEDGEMENT OF RISK: I, the Participant, acknowledge that my participation in fitness activities, including but not limited to, CrossFit workouts, weightlifting, running, jumping, and any use of equipment and facilities of the Company, have inherent risks and dangers that no amount of care, caution, instruction, or expertise can completely eliminate.

  2. ASSUMPTION OF RISK: Despite the risks involved and as consideration for being allowed to participate in the Company's activities, I voluntarily assume all risks, both known and unknown, of participating in these activities.

  3. RELEASE OF LIABILITY AND WAIVER OF CLAIMS: I hereby release the Company, its employees, officers, directors, and agents, from any and all claims, actions, damages, liabilities, losses, costs, and expenses, including attorney fees, for death, injury, loss, or damage of property, directly or indirectly arising out of or in connection with my participation in the activities or use of the Company's facilities and equipment, whether or not such injury, loss, or damage was caused by their negligence or from any other cause.

  4. INDEMNITY: I agree to indemnify, defend, and hold harmless the Company, its employees, officers, directors, and agents, against any and all claims arising out of or relating to my participation in the activities or use of the Company's facilities and equipment.

  5. FITNESS AND HEALTH: I declare that I am physically fit and mentally capable of participating in such activities. I am not, and will not be, under the influence of alcohol or any drugs that could impair my ability to safely participate in the activities. I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy to participate in the activities.

This agreement shall be governed by and interpreted in accordance with the laws of the state of Victoria. If any provision of this agreement is determined to be unenforceable, all other provisions shall be given full force and effect.

I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY.
