Membership Contract Terms and Conditions

• "Energetic Capacity" Membership payments are deducted on a weekly direct debit basis through Ezi Debit. Terms and conditions must be adhered to at all times. Fees and charges will be fully disclosed on sign- up. Members will pay admin fee of each direct debit.
• The membership fee is 12 months from the date of the signed form unless otherwise agreed upon. If a lock in contract is agreed, the membership can not be canceled for 12 months
• "Energetic Capacity" reserves the right to change prices and conditions of membership after giving a prior 30-day notice.
• All Members are required to fill in a pre-exercise questionnaire prior to starting a membership with "Energetic Capacity".
• "Energetic Capacity" reserves the right to request a medical clearance prior to establishing an agreement.
• Members are required to let staff know if circumstances change in regard to sickness or injury and reserve the right to cease existing agreements should medical issues not be disclosed or medical issues arise and a medical clearance to proceed is not provided.
• "Energetic Capacity", owners, directors, and employees relinquish responsibility should you knowingly use equipment that may adversely affect any medical conditions or disabilities resulting in sickness, injury, or death.
• All persons entering "Energetic Capacity" agree to be subject to video surveillance and recording for security purposes excluding inside of bathrooms & change rooms.
• All persons entering "Energetic Capacity" agree to enter at their own risk and may be held responsible for allowing non members to enter without permission.
• Members also agree that photographs & videos may be taken and may be used in any of the media used by "Energetic Capacity" promotions including newsletters, leaflets, posters and social media. They may also be circulated to the media. The photographs & videos may also be used to promote the "Energetic Capacity" website and social media i.e. Facebook or Instagram.
• "Energetic Capacity" is not liable for any loss, damage, or theft of personal items left unattended within the facility.
• Any member responsible for any loss, damage, or theft of "Energetic Capacity's" property will have their membership terminated immediately and will be liable for all costs incurred for its repair or replacement.
• "Energetic Capacity" reserves all rights to restrict, terminate or re-evaluate your membership should there be a health or safety concern, non-compliance, illegal or harmful conduct by the member, or failure to make payments.
• "Energetic Capacity" will have its membership contract available & on display at any time for all members to see.
• "Energetic Capacity" will shut down for 2 weeks at Christmas time during this time payments will still be taken out on a weekly basis as agreed upon at sign-up.
• Membership can be placed on hold or cancelled in person if a 14-day notice is given - memberships will be placed on hold at management's discretion. Holds exclude 2 weeks Xmas period.
• All members will adhere to the above terms and conditions.

1. I waive all claims or causes of action which I might otherwise have arising out of loss or life or injury, damage, or any other loss, which I may suffer in the course of or consequent upon my entry or participation in any activities in the gym.
2. This waiver, release and discharge shall operate separately in favour of any person involved in the ownership and/or operation of the gym. The waiver shall operate whether or not the loss, injury or damage is attributable to the act or neglect of any one or more of such persons.
