Terms and Conditions

These are the terms and conditions upon which Inner West CrossFit Pty Ltd t/a CrossFit Marrickville (ABN 16151674341) (“CrossFit Marrickville”) offers memberships for use of its facility. By purchasing a CrossFit Marrickville membership, you are acknowledging your acceptance of these terms and conditions. 

TERMS & CONDITIONS

This agreement sets out the terms and conditions in respect of your membership contract with CrossFit Marrickville.

INDUCTION: You, (member) are required to undertake an initial introduction to the facilities prior to using them.

CONDITIONS OF ENTRY: If you fail to meet the dress code for the Centre, engage in abusive, threatening, dangerous or inappropriate behaviour, are, or appear to be, under the influence of drugs or alcohol, you may be refused entry to, or asked to leave the Centre.

DRESS CODE: At all times whilst attending the Centre, you must wear clean, safe, appropriate and inoffensive exercise apparel and clothing and fully-enclosed footwear.

TOWEL: At all times you must use a clean towel whilst exercising at the Centre.

YOUR HEALTH & PHYSICAL CONDITION: You confirm to us that you are in good physical condition when joining CrossFit Marrickville and whenever you use the gym and/or undertake training by any of the gyms coaches that you are not aware of any medical or other reasons that might be detrimental to your health, safety, comfort or physical condition.

LIABILITY: You acknowledge that all activities and training undertaken by you are solely at your own risk.

USE OF EQUIPMENT: At all times, I agree to use the exercise equipment in a safe and appropriate manner and in accordance with any instruction or directions given to me by any CrossFit Marrickville Coach. After use, I will wipe down and/or return each item of equipment, as applicable, to the relevant location.

PERSONAL PROPERTY: You are responsible for the care of your property and valuables while in CrossFit Marrickville.  CrossFit Marrickville accepts no responsibility or liability for any loss or damage.  Any property left in the gym and unclaimed after 2 weeks, will be disposed of.

RIGHT TO CANCEL DURING COOLING OFF PERIOD: The cooling off period starts from the moment I enter an agreement with CrossFit Marrickville. The cooling off period ends 48hrs after the cooling off period starts.  During the cooling off period, I may cancel this agreement by notice to CrossFit Marrickville. 

ADMINISTRATION FEE: If I cancel my membership within the cooling off period CrossFit Marrickville is entitled to charge an administration fee of $85, to cover its expenses in cancelling a membership.

MEMBERSHIPS: This agreement is a legally binding obligation for which I am financially responsible.  If I fail to pay any amount when due under this agreement, I must immediately pay the entire amount owing.  This is an ongoing membership agreement.  If any fees are outstanding, we will be entitled without obtaining further authority from you to charge them to your nominated account. 

NO TRANSFER OF MEMBERSHIP: Memberships are personal and are not transferable.  You may not lend your membership to anyone else.

MEMBERSHIP HOLD: You have the right to place your membership on hold for a minimum of 1-week and a maximum of 6 weeks, within a 6-month period.

Membership hold requests must be submitted no less than seven (7) business days before your scheduled hold start date. Upon expiration of the hold period that you select, your account will automatically re-activate and regular membership payments will resume. If you choose to cancel your membership during the hold period, the standard cancellation notice requirement stated in our membership terms and conditions is applicable. Memberships holds cannot be backdated. 

CANCELLATION OF MEMBERSHIPS: All cancellation of memberships are required to give 14-days notice. If you have a scheduled payment within this 14-day period, the payment will be processed as scheduled. All payments are non-refundable.

If you decide to reactivate your membership in the future membership rates in effect at the time of reactivation will be applicable as membership rates are subject to change.

NOTICES: Whenever these terms refer to notice being given by you or by the Centre, the notice must be in through the website / forms above.

RULES: You agree to comply with the rules that in place for the Centre.  This includes, the Exercise Areas, General Areas, Kitchen, Social Room, Creche, Bathrooms, and Carpark Area.

Children must be supervised at all times in these areas. Children under the age of 15 are not permitted to use the gym unsupervised. 

The Terms & Conditions may be updated at any time.  The terms will be made available to all members through email address provided.
New Member Liability Waiver
You confirm to us that you are in good physical condition when joining CrossFit Marrickville and whenever you use the gym and/or undertake training by any of the gyms coaches that you are not aware of any medical or other reasons that might be detrimental to your health, safety, comfort or physical condition.

While training with CrossFit Marrickville, I understand that physical exercise can be strenuous and have been informed of, understand and am aware that any exercise program, whether requiring the use of exercise equipment, is a potentially hazardous activity. 

I also have been informed of, understand and am aware that any exercise and/or fitness activities involve a risk of injury, as well as abnormal changes in blood pressure, fainting and a remote risk of heart attack, stroke, other serious disability or death, and that I am voluntarily participating in these activities and using equipment and machinery with full knowledge, understand and appreciation of the dangers involved. 

I hereby agree to expressly assume and accept any, and all risks of injury, regardless of severity, or death. 

I have been advised that during participation of any activity with CrossFit Marrickville that I have the right to stop doing this activity immediately if I feel unsure, uncomfortable or feel my health or safety is at risk.

You are urged to obtain a physical examination from a doctor before participating in any exercise activity. You agree that if you engage in any physical exercise or activity, you do so entirely at your own risk. If I have chosen not to obtain a physician’s consent prior to beginning this fitness program with CrossFit Marrickville I hereby agree that I am doing so solely at my own risk. 

In any event, I acknowledge and agree that I assume the risks associated with any, and all fitness related activities and/or exercises in which I participate. You agree that you are voluntarily participating in these activities and assume all risks of injury, illness or death. 

This waiver and release of liability includes, without limitation, all injuries, which may occur as result of: 

(a) your participation in any activity or personal training session 

(b) equipment belonging to CrossFit Marrickville or to yourself that may malfunction or break 

(c) any, slip, fall or dropping of equipment 

(d) negligent instruction or supervision. 

You acknowledge that you have carefully read this “waiver and release” and fully understand that it is a release of liability. You expressly agree to release and discharge your CrossFit Marrickville Coach from any, and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against CrossFit Marrickville and their respective agents, heirs, assigns, contractors, and employees for personal injury or property damage. To the extent that statute or case law does not prohibit release for negligence, this release is also for negligence on the part of the CrossFit Marrickville Coach. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision of provisions severed here from. 

By signing this release, I acknowledge that I understand its content and that this release cannot be modified orally. This form is an important legal document that explains the risks you are assuming by beginning an exercise program. It is critical that you have read and understand this document completely. 

If you do not understand any part of this document, it is your responsibility to ask for clarification prior to agreeing it.
